THE GENERAL BUSINESS TERMS AND CONDITIONS
The general business terms and conditions (hereinafter referred to as „GBTC“) regulate the legal relationships between the owner of the ticket and/or the user of the website www.ticketportal.sk on one side and the Organizer, represented by the company Ticketportal SK, Ltd., with the domicile of Karadžičova St. 14, 821 08 Bratislava, ID: 35 850 698, IČ DPH SK2020289172, incorporated in the business register of the District court Bratislava I, div. Sro, inl. No. 28073/B on the other side.


1. THE DEFINITION CONCEPT, THE PRELIMINARY CLAUSES



1.1. TICKETPORTAL SK, Ltd.
Ticketportal SK, Ltd. mediates sales of the tickets for the event for the Organizers.
The Organizers, through the Ticketportal SK, Ltd., are using the website www.ticketportal.sk and the information, sales and booking system Ticketportal (hereinafter referred to as “the Ticketportal System”).
Through the System Ticketportal, available on the website www.ticketportal.sk, as well as through the Points of Sale, it is enabled to each person interested in the Events to obtain the information, mostly about different events, and consecutively to realize the mediation of the ticket sale, respectively to realize the booking of ticket for the Events, selected by interested person.

1.2. THE EVENT
The Event is a public event, performance, concert or a social event, especially of the culture or sports character (e. g. theatre performance, dramatic performance, music performance, audio-visual performance, movie performance, sport event), on which the sale of the tickets is being mediated by the Ticketportal System, and which is operated or organized by the Organizer.
Events represent services related to free time activities, which are the Organizers obliged to provide within the agreed timeline, respectively period.
The current list of the Events is available at the Points of Sale of the Ticketportal SK, Ltd. and on the website  ww.ticketportal.sk.
Information about the Events which are taking place outside the territory of the Slovak Republic and are not published in the Event list on the website www.ticketportal.sk, may be provided to the persons interested in the Event upon their request at the Point of Sale of Ticketportal SK, Ltd.

1.3. THE ORGANIZER
The Organizer is a person promoting, operating or organizing the Event, respectively mediating its accomplishment (hereinafter referred to as “the Organizer”), which is with Ticketportal SK, Ltd. in a contractual relationship, enabling the Ticketportal SK the mediation of the ticket sale for the Events and the execution of related activities within the scope of the granted authorization.

1.4. THE POINTS OF SALE
The Points of Sale of the Ticketportal SK, Ltd. are all authorized stores of the Ticketportal SK. Ltd. The current list of the Points of Sale is published on the website www.Ticketportal.sk.

1.5. THE TICKET
The Ticket is a policy paper and a validation, which is enabling its owner for the charge (generally unrepeated) the entry to the Event, for which was it purchased. The Ticket is not possible to offer for another sale, to give back to the sale, to swap or to print its duplicate in unwarranted way. The alteration, the falsification or the reproduction of the tickets is in a conflict with this GBTC and with relevant legislation as well and it may inflict civil or criminal law consequences. The Ticket is valid only with the counterfoil, without the adaptations and the damages, for the unrepeated entry, for which was it purchased(with exception of the Ticket for the Event, which is lasting one and more days /so-called season-ticket/, which enables the repeated entry to the Event during his lasting) and it is not possible to use it for the entry to the other Event. After the quitting the Event´s venue is the Ticket invalid, with the exception to the Ticket for Event that is lasting one and more days. The current prices are published at the Points of Sale of the Ticketportal SK, Ltd. and on the website www.ticketportal.sk. The Ticket serves for the owner of the ticket as a receipt of its purchase. In case the interested person requires another document than the Ticket, it is necessary to buy the Ticket at the Point of Sale of the Ticketportal SK, Ltd. in OC Central, Bratislava and ask for such a document prior to this purchase.

1.6. THE VOUCHER
The Voucher is the coupon for the payment in the value, which is specified on the voucher.
The voucher value is possible to draw only in non-monetary form.
In case of the higher price of the ticket, which is bought for the voucher, pays the interested person the difference at the Point of Sale.
The voucher is non-changeable. The voucher is possible to use only once.
The voucher is possible to use only for purchasing the Events, which are taking place in the Slovak Republic.

1.7. THE TICKET OWNER
The Ticket Owner is a person, which has purchased the Ticket at the Point of Sale or directly in the Ticketportal System through the website www.ticketportal.sk. The Owner of the ticket is not allowed to offer the Ticket for further sale. We recommend that the Owner of the Ticket had to be registered on www.ticketportal.sk. The Owner of the ticket by purchasing of ticket or by his attendance at the event grants without any entitlements, in accordance with applicable laws on the protection of personal data, as amended, his permission to the Organizers and the third persons as a processors of personal data for the making and publicizing of any kind of records (photos, video and audio record), which is made in appropriate way on the Event or in the relation with it for the art purposes and for the print, movie, radio and television news service. Ticketportal SK, Ltd. bears no liability for any breach of statutory and other obligations of the processor of personal data as long as it is not Ticketportal SK, Ltd. or a subject empowered by it.


2. THE SORTS OF THE TICKETS

2.1. The standard paper ticket with the safety elements
The standard ticket, which is issued at the Point of Sale after the paying the Ticket full-price, must contain:
1. the Event´s name, the date of the Event, the time of the Event´s beginning, the Event´s venue, the Ticket price and the identification of the Event´s purchased place, the sales number
2. on the left side the date and the time of the Ticket´s sale, the identification of the Outlet, where was the Ticket purchased, the unique identification code of the purchased place, the hologram and the number series of the Ticket sheet
3. on the right side the entire unique bar code and the summary of data, which are on the Ticket
4. the identification and the tax data of the Event´s Organizer

2.2. HOMEticket
A method of Tickets´ distribution, namely by the own Ticket´s print on the bond paper sheet A4 explicitly by the laser printer (any other form of print will be not accepted!) on the basis of the internet booking and the payment of the Ticket full-price (more on www.hometicket.sk ).
The own-printed Ticket must contain:
1. the Event´s name, the date of the Event, the time of the Event´s beginning, the Event´s venue, the Ticket price and the identification of the Event´s purchased place
2. the sales number
3. on the right side the entire unique bar code
4. the identification and the tax data of the Event´s Organizer

2.3. MOBILticket
An electronic Ticket displayed in the form of a unique bar code or QR code, containing the text describing the Event and enabling the Ticket Owner an entry to the Event. The Bar Code or QR code is delivered in the form of email message to the Owner of the Ticket on the basis of the internet booking and the payment of the Ticket full-price.
Upon the request, the Point of Sale which sells the MOBILticket to its Owner, issues at the purchase, a written confirmation containing the Event´s name, the date of the Event, the time of the Event´s beginning, the Event´s venue and the Ticket price.

2.4. BOOMticket
An electronic ticket displayed through the BOOMticket app, installed on the mobile phone of the Ticket Owner, completely replaces a standard paper ticket printed on the operator´s forms (Ticketportal hologram form).
 

3. THE SORTS OF THE VOUCHERS


3.1. The Ticketportal voucher
The Voucher issued by the Ticketportal SK, Ltd. in the nominal amount of 5, 10, 15, 20 or 50 euros. The Ticketportal voucher can be used only personally at the selected Points of Sale of the Ticketportal SK, Ltd. network, that are marked with the logo “Poukážka” (Vouche)r in the section „Points of Sale “. The Ticketportal voucher is printed on a policy paper with the hologram of the company or as a HOME Ticket. The Ticketportal voucher can be purchased personally at the selected Points of Sale or through the website www.ticketportal.sk.
The valid Ticketportal voucher must contain:
1. the title “Poukážka Ticketportal” (the Ticketportal voucher), the nominal amount, the validity of the Voucher, the instructions of the applications
2. on the left side the date and the time of the Voucher´s sale, the identification of Voucher´s seller, the hologram, the number series of the sheet, the sales number
3. on the right side the entire unique bar code and the summary of data, which are found on the Voucher

4. THE CONTACTUAL RELATIONSHIP

4.1. Ticketportal SK, Ltd., pursuant to the contract concluded with the Organizer, ensures as a mediator the Ticket sale for the Event on behalf of the Organizer, and, at the same time, on behalf of the Organizer, it takes in from the interested persons the financial funds, which are corresponding to the Ticket´s purchase price. Through the payment of the Ticket price, i.e. through the Ticket´s purchasing at the Point of Sale or on the website www.ticketportal.sk,  the Ticket Owner directly enters into the legal relationship with the respective Organizer of the selected Event. The information about the Events is published at the Points of Sale and on the website www.ticketportal.sk. The information about the Organizers is published at the Points of Sale and on the website www.ticketportal.sk. The business name of the Organizer is provided to the persons interested for the Event/Ticket Owner at the Points of Sale, anytime upon their request, even before purchase of the Ticket. The contract between the Organizer and the Ticket Owner is concluded for a certain time, until the end of event, respectively, until the settlement of the claims resulting from this contract.

4.2. The Organizer is responsible for any Event Change. Ticketportal SK, Ltd., is not empowered by the Organisers to provide control on specific Events, does not guarantee and does not take any responsibility for the Events, any changes during the sale of the Tickets for the Events, or possible changes in the organization of the Event. The legal relationship between the Organizer of the Event and the Ticket Owner is governed, except for this GBTC, also by other business terms and condition of the given Event, the instructions of the Organizer, the organizer services and the operating rules of the Event.

4.3. Ticketportal SK, Ltd. ´s information published on www.ticketportal.sk and at the Points of Sale are based on information´s sources provided by the Organizers of the Events. If the Ticketportal SK, Ltd. has the information from the Organizers about cancelling or changes of the Event, it will notify the Ticket Owner via the website www.ticketportal.sk

4. 4. Ticketportal SK, Ltd., is a provider of the website www.ticketportal.sk, and it enables to the Ticket Owners or to the persons interested in the Event, an access to this website, and by that, also to the Ticketportal System, including the registration on this website.


5. RIGHTS AND OBLIGATIONS OF THE TICKET OWNER



5.1. The Ticket Owner has a right to use the Ticket for the single entry to the Event, to which was it purchased (with exception of so-called season-ticket, i.e. the Ticket for the Event, which is lasting one and more days – e. g. music festivals etc.). After the leaving the Event´s venue loses the Ticket (except the so-called season-card) its validity.

5.2. The Ticket Owner has a right to use the services, that are offered at the Event. The Ticket Owner is obligated to show the valid ID card upon the request of the Organizer, respectively to the persons empowered by the Organizer. The Ticket Owner becomes through the ticket purchase a contract partner with the Organizer of given Event.

5.3. The Owner of the ticket is obligated to check the Ticket and the data on it immediately after the ticket price payment and the obtaining of the Ticket (in the case of the standard ticket), eventually after the obtaining an electronic Ticket or after the printing the Ticket by own print (in the case of the MOBILticket, BOOMticket or the HOMEticket) and to make a claim in case of the contingent defects without any delay pursuant to article 13 of these GBTC.

5.4. The Ticket Owner is obligated to preserve the Ticket (the standard ticket) carefully as a tax document. As a negligence in use is considered the circumstance, when the third person can get possession of the Ticket without any considerable effort and in a prohibited way.

5.5. The Ticket Owner has a right to use the Ticket only for the purposes, for which is it assigned. Any other usage of the Ticket is prohibited.

5.6. Ticketportal SK, Ltd. recommends to the Ticket Owners to inquire about the possible changes related to the Event, for which was the Ticket purchased, including the possible cancellation of the Event, namely at the Points of Sale or on the website www.ticketportal.sk (the section „Event changes“).

5.7. While submitting the Ticket at the entry to the Event, the Owner of the Ticket expresses his agreement with the instructions of the Organizer in the Event´s venue and with the conditions, which are bounded with them and undertakes to follow them. The instructions of the Organizer, organizer services or the operating rules of the Event are available either on the website www.ticketportal.sk by the specific event, or are published before the entrance to the event. In case of its breach, the organizer is entitled to proceed in accordance with its instructions, respectively the rules of the Event, even e. g. in the form of banning a further participation of Ticket Owner at the Event without any form of refund of the ticket price and/or other harm to the ticket Owner.
5.8. In specific cases, such as e. g. at the public sport events, risky events, based on the decision of the Organizer or the sports federation, the Tickets for the Event will be issued on a given name and surname of the person attending the Event. The person interested for the event/ The Ticket Owner is responsible that the provided data is accurate. Personal data of another person is the interested person entitled to provide only with the prior written consent of the data subject. 

6. THE RANGE OF SERVICES, THE CHANGE OF THE RANGE OF THE SERVICES FOR THE EVENT

6.1. The services offered at the Events are not the services of the Ticketportal SK, Ltd. The GENERAL INSTRUCTIONS OF THE ORGANIZER of the given Event are valid for the specific Event. For the Organizer, the Ticketportal SK, Ltd. provides only the mediation of the sale of the Tickets for the Event and other related activities, in the scope of the authorization. Therefore Ticketportal SK, Ltd. does not bear any responsibility for the content, nature, quality, or other parameters of the Event, nor for any infringement of the rights of the Ticket Owner in connection with the Event, e. g. its cancellation. Such a claim is a claim against the Organizer, and Ticketportal SK, Ltd. is not authorised by the Organizer to any legal acts related to this, unless these GBTC does not stipulate otherwise.

6.2. To the restriction of the service offer for the Events and of the use of the services can come due to the unfavourable weather conditions, in the consequence of circumstances related with the season, with the health state of the performer etc. The Organizer reserves the right to change the Event. In case serious reasons appear, which are related to the restriction of the offered Event, the Organizer is obligated to inform the Ticket Owners and the persons, interested in the Event through the website www.ticketportal.sk, in the section „Changes“, about the change, the cancellation, the alternate date of the Event, eventually about the place and the time of the admission refund. The Ticket Owner has no right to any compensation or ticket price reduction, if he participated at the Event, or if he used the offered alternate date of the Event and also, has he no right to compensation of any other expenses (transport to the Event´s venue, accommodation, board-money, the ticket delivering etc.).

6.3. In case of the CHANGE of the Event – the reduction of the range of the provided services, the financial funds, representing a given part of the Ticket price, are refunded by the Organizer within reasonable limits, if not specified otherwise by the Organizer. The place, the time and the way of the refund of the specific part of the Ticket price specifies the Organizer and he also notifies the Ticket Owners about it by the website www.ticketportal.sk, in the section „Changes and Cancellations“.

6.4. In case of the CANCELLATION of the Event, the financial funds representing the price of the Ticket are refunded by the Organiser to the Ticket Owners, without undue delay, after the publication of the notification on the cancellation of the Event by the Organizer. The Owners of the tickets are entitled to file a claim for the refund of the admission no later than within 3 years period from the planned accomplishment of the Event. The place, the time and the way of the admission refund specifies the Organizer and he also notifies the Ticket Owners on it at the website www.ticketportal.sk, in the section „Changes and Cancellations“.


7. REGISTRATION


7.1. For a direct purchase of the Tickets via the website www.ticketportal.sk, it is not necessary to be registered on the website www.ticketportal.sk, however, it is recommended, to make better use of Ticketportal System services (e.g. to be informed about changes / cancellation of the event, possibility to follow history of orders, re-printing of Tickets, no need to re-fill data, etc.).

7.2. In case, pursuant to these GBTC, the Ticketportal SK, Ltd. uses the option to block particular registered user´s access to the Ticketportal System on the website www.ticketportal.sk, it is an exercise of the Ticketportal SK, Ltd. right, which is not linked to the formation of any claims of the user, whose access has been blocked, especially, but not exclusively, any claims associated with the loss of access, the loss of data and information contained in the registered profile of the user, etc. The personal data protection is not affected by this.

8. TICKETS BOOKING

8.1. Booking
The person interested in the Event may book the Ticket for the given Event through the website www.ticketportal.sk.
If not specified otherwise by the Organiser, the Ticket booking is valid for 3 days from its realization. The repeated re-booking of the places is considered to be intentional blockage of the places and with that indirect damaging of the Organiser and the Ticketportal SK, Ltd. Such bookings may be, after prior notifying, cancelled and the user, who created such bookings, may have the access to the Ticketportal System on www.ticketportal.sk blocked.

8.2. Booking Cancellation
In the case experiencing problems with the booking cancellation, the registered user may write to help@ticketportal.sk. In such case, will be the tickets booking for the registered user cancelled without any fees.
The ticket booking may be realised only by person (manually), through person´s own registration. The usage of any automatized systems, eventually functions for the realization of the ticket booking, eventually the markings of the places is prohibited. Such automatic reservations will be cancelled without warning and the registered users, through whose were these automatic reservations created, will get their access to www.ticketportal.sk blocked.

8.3. In case of the Event´s cancellation, the Ticket Owner is notified by the website www.ticketportal.sk, in the section „Changes and Cancellation“, on the procedure of the admission refund by the Organizer, as well as on the list of the venues and the contacts, through which the admission refund will be realized by the Organizer. The registered users, eventually the Ticket Owners, who, upon Ticket purchase on the website www.ticketportal.sk, provided their email address, will be notified on the cancellation of the Event also via email message.

9. THE TICKET PAYMENT

The person interested in the Event may pay the Ticket through the website www.ticketportal.sk, eventually at the Point of Sale.

9.1. The price of the booked, respectively, selected Tickets is possible to pay as follows:

9.1.1. With the credit card by the internet network through CardPay system (the payment through the virtual POS Terminal of Tatra bank). You can pay with the credit cards VISA and EUROCARD/MASTERCARD. You can use the above-mentioned cards issued by any bank institution.

9.1.2. With the internet banking through the bank, by which you have your bank account and the logo of this bank is placed on the website, where you are completing the Ticket booking.

9.1.3. In cash at the selected Points of Sale. For this way of the payment and the following possibility of the Ticket collection, it is necessary to preserve the reservation number, as well as, to enter all the requested data in the registration form, because the clerk at the Point of Sale, who will issue the given Tickets, will require the advice of the relevant data from the person interested in the Event.

9.1.4. For the booking/prescription/ the payment/invoice, while for this case, if the booking/prescription/ invoice is paid by the payment order from the account, it is possible to book the tickets at latest within the 20 days period prior to the realization of the Event, if not specified otherwise in the description of the Event or in the instructions of the Organizer.  Any further information may be found on: objednavky@ticketportal.sk.

9.2. In cases of payment pursuant to point 9.1.1. and 9.1.2., the financial funds in amount of the price of the booked Tickets will be charged from the given account immediately after the confirmation of the payment.


10. THE DELIVERY TERMS

10.1. By booking personally at any of the Points of Sale, on the basis of the booking number.

10.2. If you are paying by credit card / internet banking, please indicate which form of Ticket receipt you are interested in (personally at the Point of Sale, / post - mail, / courier, / shipping company / HOMEticket, / MOBILticket, / BOOMticket).

10.2.1. personally, at any of the Points of Sale, namely on the basis of the variable symbol and the confirmation code, without any charge (the standard ticket) at the own Point of Sale of the Ticketportal SK, Ltd. or with the optional administration charge at the authorized Point of Sale. The current list of the Points of Sale including the information about charges is published on www.ticketportal.sk.

10.2.2. by the courier / shipping company, and the delivery fee (postage, shipping and packing) will be charged in the full amount to the Ticket Owner (Standard Ticket). The delivery fee is shown currently at the payment.

10.2.3. by the sending QR code via email message free of any charge (MOBILticket)

10.2.4. by the print-out on the bond paper sheet A4 by the laser printer (any other form of print will be not accepted!) free of any charge (HOMEticket).

10.2.5. by an electronic ticket displayed through BOOMticket application.

10.3. The Organizer is obliged to:
10.3.1. in the case of the standard ticket to enable to the Ticket Owner to collect the booked tickets at the Point of Sale, on this is the Ticket Owner notified by the e-mail. The current list of the Points of Sale is published on www.ticketportal.sk.

10.3.2. to notify the Ticket Owners without any delay via the website www.ticketportal.sk about all changes occurred by the specific Events.

10.4. The Owner of the Ticket is obliged to:
10.4.1. to collect the booked Tickets in the specified time before the realization of the Event (the standard tickets)

10.4.2. to pay the agreed price for the booked Tickets in the full amount

10.4.3. to collect the Tickets paid through internet, at the least 24 hours before the beginning of the event. Otherwise, nor the Organizer, or the Ticketportal SK, Ltd. is responsible for any damage on the part of a Ticket Owner associated with the inability to collect the tickets.

10.4.4. to specify all the data requested by the Ticketportal SK, Ltd. and by the Organizer complete and true.

10.5. The Ticket Owner takes into mind that:
10.5.1. for the delayed delivery of the ordered Tickets, caused by the post, eventually the express mail-order or any other subject who arranges the transport of the Tickets (hereinafter referred to as the “transporter”), if the Ticketportal SK, Ltd. provided the transportation on time, the transporter is responsible.

10.5.2. for the delayed delivery of the ordered Tickets caused by the Owner of the ticket, who does not respect the post, courier, shipping company delivery terms, or did not pick up his tickets on time respectively, the Ticket Owner is responsible.
10.5.3. for the delayed collection of the Tickets by the Owner of the ticket at the Point of Sale and thereby the delayed arrival to the Event, the Ticket Owner is responsible.

10.5.4. for the non-delivery of the Ticket, caused by incomplete, outdated or in any other way incorrect data entry of the post address by the Owner of the Ticket, the Ticket Owner is responsible.

10.5.5. for the not using of the Ticket for the Event, the Ticket Owner is responsible.

10.5.6. for the checking of the Tickets upon its collection at the Point of Sale by the Owner of the ticket, the Ticket Owner is responsible.

10.5.7. for the damage or the loss of the delivery caused by the post, eventually the express mail-order or any other subject who arranges the transport of the Tickets, the transporter is responsible.

10.5.8. for the change or the cancellation of the Event, while in this case it will be published on the website www.ticketportal.sk, in the section „Changes and Cancellation“ the way of the paid admission refund by the Organizer, is responsible the Organizer; while the Ticketportal SK, Ltd. is not a subject obliged to refund admission to the Ticket Owners, if such action is carried out by the Ticketportal SK, Ltd., it is done only on the base and in the scope of the granted authorization, and therefore, Ticketportal SK, Ltd. does not carry any obligation from this title in respect to the Ticket Owners.

10.6 In case that the situation stipulated in points 10.5.1, respectively in 10.5.7 occurs, the Ticket Owner is obliged to immediately contact Ticketportal SK, Ltd and provide the necessary co-operation to apply the Claim to the contractual partners (Slovenská pošta, or other selected delivery service).
 

11. WITHDRAWAL FROM THE CONTRACT

11.1. In case of the purchase of the Ticket, including specific kinds of electronic tickets and/or HOMEticket, it is not possible to withdraw the contract with the Organizer and claim the admission refund, and that, regardless the fact, whether the ticket was boughed directly at the Point of Sale or via the website www.ticketportal.sk, eventually via other websites using the Ticketportal System, because, pursuant to §7 (6) k) of the Act No. 102/2014 Coll. on the consumer protection, by the selling of the goods or providing services based on the distance contract, or on the contract concluded outside the business premises of the seller, the consumer may not withdraw the contract, subject of which is the provision of the services related to free time activities, and according to which is the seller obliged to provide such services in agreed time or agreed period, while the contract to purchase the Ticket for the event represents the contract, based on which is the seller, that is the Organizer, obliged to provide to the Ticket Owner free time services, that is the Event, in agreed time, respectively in the term of the Event taking place.  
Refund of the paid Ticket to the Event is not possible, unless this GBTC stipulates otherwise. At the same time, it is not possible to claim the refund of the admission by the Ticket Owner in case of not using of the Ticket.

11.2. In case of purchase of the Ticket directly at the Point of Sale, it is not possible to withdraw from the contract and claim the admission refund. Refund of the paid Ticket to the Event is not possible, unless this GBTC stipulates otherwise. At the same time, it is not possible to claim the refund of the admission by the Ticket Owner in case of not using of the Ticket.


12. THE LOSS, THE THEFT, THE DAMAGE OF THE TICKET

12.1. In case of loss or theft of Tickets, the Ticket Owner is obliged to report this incident to Ticketportal SK, s.r.o. as soon as possible. by sending an e-mail to help@ticketportal.sk or by sending a written post to the address Ticketportal SK, s.r.o., Karadžičova 14, 821 08 Bratislava. If the incident is reported to the police, it is obligatory also to submit to the Ticketportal SK, s.r.o. a police record. In case that the Ticket Owner can be verified (e.g. if the Ticket Owner made a booking and/or paid Tickets through his registration via the Internet at www.ticketportal.sk), Ticketportal SK, s.r.o. after consulting with the Organizer and its explicit approval, issues the Ticket to the Owner, upon completion of the affidavit, for a handling charge of EUR 5, - new, replacement Ticket, confirmation that will entitle the Ticket Owner to enter the Event for which the Ticket has been stolen / stolen.

12.2. In case of Damage to the Tickets, the Ticket Owner is obliged to report the incident as soon as possible to Ticketportal SK, s.r.o. by sending an e-mail to help@ticketportal.sk or by sending a postal mail to Ticketportal SK, s.r.o., Karadžičova 14, 821 08 Bratislava, and submitting the damaged Ticket (or any part of it) and an affidavit stating the manner of the damage. Ticketportal SK, s.r.o. after consulting the Organizer and expressly approving it, will issue to the Owner tickets for a handling charge of EUR 5, - a new, replacement Ticket which will entitle the Ticket Owner to enter the Event for which the Ticket was damaged.


13. CLAIM GUIDELINES

13.1. In case, if the purchased Ticket contains the defects (i.e. there are not listed some data on the Ticket according to article 2 of these GBTC, eventually the Ticket contains incorrect data, the Ticket is issued for the other Event, as the Owner of the ticket had booked it for etc.), is the Ticket Owner obligated to complain these defects without undue delay after the obtaining of the Ticket personally at the Point of Sale, where the Ticket was purchased (the standard ticket) or in the case the delivery of the Ticket by the post (the standard ticket), in the case of the HOMEticket, MOBILticket and/or the BOOMticket by sending the e-mail message on the address reklamacie@ticketportal.sk (requests sent on different mail addresses will be not accepted as claims !) or by sending the written claim on the address Ticketportal SK, Ltd., Karadžičova 14, 821 08 Bratislava. In the case of the claiming the defects of the standard ticket is necessary to submit this Ticket (the original) to the Ticketportal SK, Ltd. (personally or by the mail posting with the claim). The Ticket Owner is obliged to check the consignment immediately after delivery in the presence of the delivery agent. If a defect is found and / or if the consignment is incomplete, the delivery agent is obliged to allow the Ticket Owner to make a record of the extent and nature of the defect, which should be verified by signature of delivery agent afterwards. If the shipment is not complete, or if it has a manifest error in the sense of art. 13.1 of these GBTC, which the Ticket Owner could have identified by check on receive of the shipment and which he did not immediately notify to Ticketportal SK, s.r.o, later complaints of this kind will be   accepted only if the Ticket Owner demonstrates that the defects existed already at the time of receiveing by the Ticket Owner or if the ticket data does not match the details of the Ticket Owner´s order.

13.2. In the case of the claiming the defects of the Ticket at the Point of Sale will the claim be settled without delay by the clerk of the Point of Sale and the alternate solution (e. g. the issue of the new Ticket) will be offered to the Ticket Owner.

13.3. In the case of the claiming the defects of the Ticket by the e-mail or by the post the Ticketportal SK, Ltd. sends in the period of 3 workdays from the receiving the claim (including the original of the Ticket, if it is the standard Ticket) to the Ticket Owner in the same form (by the e-mail or by the post) the statement to the claim and depending on the date of the Event suggests to the Ticket Owner the way of the elimination of the Ticket defects (sends a new Ticket /the standard ticket, electronic ticket/, enables to the Owner of the Ticket to print-out a new Ticket /HOMEticket/, sends the list of the Points of Sale, where it will be possible to collect personally a new Ticket etc.). The claiming the defects will be not accepted after the realization of the Event, eventually after cancellation of the Event.

13.4. In case of a claim of other facts by email or postal service, Ticketportal SK, Ltd. will send a statement to the ticket owner within 3 working days of receiving of the claim (including original ticket, if it is a standard ticket). Statement will be sent to the ticket owner in the same form (e-mail or by postal service) as a received claim. The claim will be processed within the statutory period.

13.5. If the consumer is not satisfied with the seller's handling of his complaint or if he believes that the seller has breached his rights, he has the opportunity to contact the seller for a rectification. If the seller dismisses or fails to respond to a request for correction within 30 days from the date of receiving it, the consumer has the right to file a petition for an alternative dispute resolution according to § 12 of Act No. 391/2015 Coll. about an alternative customer dispute resolution and about the changes and amendments to some laws. The competent entity for an alternative customer dispute resolution with the seller Ticketportal SK, s.r.o. is Slovak Trade Inspection Prievozská 32, 827 99 Bratislava 27, www.soi.sk or other relevant legally authorized entity registered in the List of Alternative Dispute Resolution Entities maintained by the Ministry of Economy of the Slovak Republic (the list is available at http://www.mhsr.sk ); The consumer has the right to choose which of those alternative dispute resolution entities to address. Please note the paragraph 4 (CONTRACTUAL RELATIONSHIP), point 4.1 of the GBTC, according to which by purchasing the Ticket at the Point of Sale or via the www.ticketportal.sk web site, the customer enters into a legal relationship directly with a specific Organizer of the selected event.

13.6. The consumer can use the on-line dispute resolution platform to submit a proposal for an alternative dispute resolution, available at http://ec.europa.eu/consumers/odr/.


14. REFUND OF THE ADMISSION

14.1. In case of a change or cancellation of the Event, the Ticket Owner is obliged to inquire about the method, location and time of refund of the admission at www.tickeportal.sk, in the "Changes and Cancellations" section. If, according to the notification, the admission will be refunded via Ticketportal SK, Ltd, , will the notification on this, that the Ticketportal SK, Ltd is authorizes by the Organizer to admission refund in the notification on the website www.ticketportal.sk , in the "Changes and Cancellations" section. In such case, the Ticket Owner will send the request for return of the admission form by e-mail to reklamacie@ticketportal.sk  (requests sent to another e-mail address will not be considered as refund requests) or mail to Ticketportal SK, sro, Karadžičova 14, 821 08 Bratislava. For a refund request, if the payment has been made via the Internet, it is necessary to provide the relevant proof of this charge (Payment Details), Tickets, and the account number for which you request payment for the cancelled / changed Event to be paid. If the client chooses the type of the HOMEticket, MOBILticket or BOOMticket ticket, he / she will provide an affidavit that he / she did not use the Ticket to duplicate or otherwise use the Ticket and only claim the Ticket price once. In case that money is collected by another person as the Ticket Owner, it is necessary to submit to Ticketportal SK, Ltd. a written authorization from the Ticket Owner for receipt of the financial funds. If, according to the announcement, the admission is refunded directly by the Organizer, (the Ticketportal SK, Ltd. Is not empowered to admission refund) the Ticket Owner will send a return request directly to the address of the Organizer specified in the notice.

14.2. Ticketportal SK, Ltd. is not responsible for the Organizer or for the Event, a contractual relationship (in relation to a specific Event) is concluded between the Organizer and the Ticket Owner, who is required to comply with the Operations Rules, the Organizer's instructions and the Organizer's instructions. In the event of a cancellation / change of the Event, the Ticket Owner shall not be entitled to a refund for services associated with the delivery of tickets, such as postage and packing, etc.

14.3. Compensation for other expenses (transport to the venue, accommodation, food, ticket delivery, etc.) is not provided.

14.4. Sending a refund request does not constitute a claim within the meaning of paragraph 13 (Caim Guidelines) of this GBTC.


15. PERSONAL DATA PROTECTION



15.1. Ticketportal SK, Ltd. as the controller of the www.ticketportal.sk Ticketportal website, processes the personal data of the natural persons - users of the Internet site / interested persons of the Events and / or the Ticket Owner (hereinafter referred to as "the persons concerned") as a controller under Article 4 section 7 GDPR Regulation.

15.2 In order to benefit from Ticketportal SK, Ltd services such as realization of booking or purchase process and / or buy Ticketportal Tickets at www.ticketportal.sk, including related activities (delivery by courier, delivery by mail, claim handling, ticket refundation, etc.),the person interested in the event has to notify Ticketportal SK, Ltd with his/her personal data to the extent of the selected / requested services. Without providing this personal data, Ticketportal SK, Ltd (for example, without providing an email address it is not possible to book tickets, without providing the account number it is not possible to make a refund of the ticket from the cancelled event to the Ticket owner, etc.). The purpose of processing of personal data of the persons concerned is the operation of Ticketportal system and the use of its services.

15.3. For this purpose, Ticketportal SK, Ltd is processing personal data of the persons concerned to the following extent: email address, first name and surname, delivery address / billing address, telephone number, order information (Event title, ticket price, booking number, payment date, Variable Symbol) Information about benefit voucher (if the ticket has been paid by voucher), account number, payment details (in case it has been cancelled and refund has been processed through the Ticketportal SK, Ltd), online identifiers (cookies, FB pixel codes, Google Adwords codes).

15.4. Ticketportal SK, Ltd is processing the personal data of the people concerned on the basis of its legitimate interest within the meaning of Article 6 section 1 letter f, GDPR regulation. The legitimate interest of Ticketportal SK, Ltd is to increase the use of the Ticketportal system, hence, the support and promotion of mediation of the sales for events at www.ticketportal.sk to the users.

15.5. The legitimate interest of Ticketportal SK, Ltd is also implementation of direct marketing. For this purpose, Ticketportal SK, Ltd processes the e-mail address of the person concerned.

15.6. In case that the Organizer of the Event delegates Ticketportal SK, Ltd as an intermediary by processing the personally identifiable information about persons interested in tickets, this information (including the identity of the Organizer as the operator and the extent of the processed personal data) will be given in the description of the Event, in the notice of change or cancellation of the Event and of the method of returning the entry fee.

15.7. As part of the Ticketportal System, interested persons are eligible for Ticket Insurance as a supplementary service. Personal data processed for the purpose of using this service are processed by Ticketportal SK, Ltd as an intermediary, on the basis of the authorization of the ERV Operator Europe Insurance Company, Inc., Prague, Czech Republic, Company Identification Number 492 40 196.

15.8 The processed personal data are preserved by Ticketportal SK, Ltd for the duration of legitimate interest, hence, it.is while the interests or fundamental rights and freedoms of the person concerned do not prevail over such interests. For example, while the person concerned is an active user of Ticketportal (www.ticketportal.sk). The legal obligation of data retention within the specified period by special regulations is not affected.

15.9 To provide certain activities and / or operations that Ticketportal SK, Ltd could not ensure through its own staff, Ticketportal uses the services of other entities. For this purpose, processed personal data are made available to the postal service, shipping companies, marketing agencies, service organizations and service providers, platform providers such as Facebook, Google Analytics.

15.10. Guidance on the rights of the person concerned: The person concerned has the right to obtain from the controller a confirmation of the processing of personal data concerning him / her. If the controller processes such personal data, the person concerned has the right to access such personal data and information about, the purpose of personal data processing ; the category of processed personal data; the identification of the recipient or the category of recipient to whom personal data have been or will be provided, particularly the recipient in a third country or an international organization; if possible, the period of personal data retention and, if that is not possible, information about the destination criteria; require the controller to correct personal data relating to the person concerned; to erase or restrict their processing or about the right to object the processing of personal data; The right to lodge a complaint to the supervisory authority; the source of personal data if they were not obtained from the person concerned; existence of automatic and individualistic decision including profiling. Person concerned has the right to correction of their personal data by controller without unnecessary delay. With regard to the purpose of the processing of personal data, the person concerned is entitled to supplement incomplete personal data. The data subject shall have the right to delete the personal data relating to him without undue delay if: the personal data are no longer necessary for the purpose for which they were acquired or otherwise processed; the person concerned withdraws the consent under which the processing of personal data is carried out and there is no other legal basis for the processing of personal data; the person concerned objects to the processing of personal data and does not prejudge any legitimate reason for the processing of personal data; personal data are processed illegally. The person concerned has the right to restrict the processing of personal data by the controller if: the person concerned objects to the accuracy of the personal data during a period allowing the controller to verify the accuracy of the personal data; the processing of personal data is unlawful and the person concerned objects to the deletion of personal data and asks, instead, to limit their use; the controller no longer requires personal data for the purpose of processing personal data but is needed by the person concerned to claim a legal claim or the person concerned has objected to the processing of personal data. The person concerned has the right to obtain personal data relating to him / her which he/she has provided to the controller in a structured, commonly used and machine-readable format and has the right to transfer such personal data to another controller if this is technically possible. The right of transferability shall not apply to the processing of personal data necessary for the performance of a task carried out in the public interest or in the exercise of official authority entrusted to the controller. The person concerned has the right to object to the processing of his or her personal data on account of his or her particular situation in the legitimate interests of the controller, including profiling based on these provisions. A controller may not further process personal data unless it demonstrates the necessary legitimate interests in the processing of personal data that outweigh the rights or interests of the data subject or the grounds for exercising a legal claim. The person concerned has the right to object to the processing of personal data relating to him for the purpose of direct marketing, including profiling to the extent that he relates to direct marketing. If the person concerned objects to the processing of personal data for the purpose of direct marketing, the controller may not process personal data for the purpose of direct marketing. The person concerned has the right not to be covered by a decision which is based exclusively on the automated processing of personal data, including profiling, and which has legal effects which affect him or her or have a significant effect thereon unless it concerns the personal data necessary for the conclusion of the contract or performance of the contract between the person concerned and the controller.

15.11. Ticketportal SK, Ltd to ensure the processing of the personal data of the persons concerned in the correct, legally and transparent manner, established the responsible person, whit whom you can contact by e-mail at zodpovednaosoba@ticketportal.sk or by mail at Ticketportal SK, s.r.o., Zodpovedná osoba, Karadžičova 14, 821 08 Bratislava.

15.12. If the person concerned suspects that his personal data are being processed unlawfully, he/she may file a complaint to the SR Office for Personal Data Protection, Hraničná 12, 820 07 Bratislava 27.

15.13. The person concerned will be called to confirm the general terms and conditions by checking the box attached to this GBTC of the Ticketportal SK, Ltd network and with this step he/she confirms he/ reads them, understands their content, and agrees with them in their entirety.

15.14. In case the contract is concluded via website www.ticketportal.sk, is the contract concluded by expressing the consent of the person interested in the Event, which is made by confirming the checkbox marked as “I agree with the purchase of the ticket according to the conditions stated above with the obligation to pay”, by this, he agrees with all data displayed before, especially the place and the time of the Event, Ticket price, payment method and way of the collection of the Ticket, possibly other additional services. The right for the Ticket is formed only after payment of the admission. The contract is concluded in the Slovak language.


RECOMMENDATIONS:

The actual information about the Events and the Programme you can find on www.ticketportal.sk, in the section „Event Alterations“, „The Ticketportal News“ or at the place of the Ticket purchase.
We recommend to inquire before the purchase of the Ticket about the prices and the eventual discounts.
We recommend to the Owners of the tickets to collect the purchased Tickets in time, in the sufficient timing advance before the Event´s realization, so that you can catch the beginning of the Event.
We recommend to use Internet Explorer, Mozilla Firefox, and Google Chrome and to have installed plug-in Flash from the company Macromedia. If you have not installed it, you will be asked before the displaying the Event´s auditorium by dialog window to the permission of download and the installation of plug-in Flash into Internet browser.
